Summary
Riverside Appellate Court judges J. Gaut, P. J. Ramirez, and J. Hollenhorst ignored the testimony of homeowners and ruled that the Desert Crest Seniors must pay $79 a month to a private club owner and developer. Many of the seniors are in their seventies, eighties and ninties and unable to use the club.
The judges said the club was a "benefit " the board could mandate fees and create liability on all the owners. In addition, the judge ordered the seniors to pay the lawyers fees. Peters & Freedman is the lawyers for the club. Previously, they were the lawyers for the association.

Causes of Action: This case filed by OSCA Development Company, plaintiffs represented by Peters & Freedman , attempted foreclosures for failure by defendants to pay alleged mandatory dues to a private country club.
Many seniors in their eighties, nineties and disabled, lost their affordable homes and life savings to pay Peters & Freedman lawyers fees and the private club owner dues for facilities they did not or could not possibly use.
