Summary

The Appellate division upheld the lower court's findings that awarded defendant $12,433 for damages from roof leaks and $5,544 to Plaintiff for unpaid maintenance fees and legal fees.

Defendant has appealed to the Supreme Court to have plaintiff's judgement set aside because of "double-dipping on legal fees" because plaintiff took money from defendant's specifically designated maintenance fee payments to pay legal fees, which were then again awarded in the judgment. The deduction then caused a "triple-dipping" on maintenance fees because maintenance fees were also awarded.
Causes of Action: Plaintiff claimed defendant was behind in maintenance fees.

Defendant was withholding maintenance fees because the association was not meeting its obligation to repair a roof leak and pay for interior damages.
