How Do I Get The Developer To Perform Maintenance On Our Condo Complex?

The common areas foilage is dying. the onsite waste treatment plant is not being maintained, the stench of sewage fills the air.

We live in a condo complex in Kona, Hawaii under a developers control. We pay about $260.00 a month in maintenance fees. Yet month by month less gets done. The common areas foilage is dying due to lack of watering. The onsite waste treatment plant is not being maintained and the stench of sewage fills the air. After numerous calls to the developer's "Contact" person, and to the management company nothing gets done. The developers says they can't afford a board or a property manager. Does anyone know what we can do now? We as well as other owners are at our wits end!!!

Our homeowner association, run by the same lady for 20 years and a board that intimidates the owners, conceals finances, keep raising dues, and refuses to provide services. I have lived here 9 years and the homeowner association fees have doublled since I first moved here and continue to be raised. Most of the owners have rented thier condos to HUD and anyone they can. We have no voice in contracts and never recieve receipts etc. Meetings are held in board presidents' homes where intimidation is stressed,forceing home owners to "give up" and accept the rules they put forth. Several new owners are trying to obtain contracts, bank statements etc. We are unable to collect proof of services rendered - which is very little. What can we do? The homeowners who , like me cannot afford to relocate are stuck paying the high fees and we don't don't stand a chance at getting on the board when it is time to vote. How do we get rid of this situation?

QUESTION: :How do I pull up a HOA Certification for; Cerro de Alcala -condo address; Rancho Mission Road , San Diego, California. HOA management company referred me to this site. AHRC RESPONSE: Check with a "Level 2 support person for Cerro de Alcala Condos" !!!! AHRC is a news and networking website by and for homeowners. Can HOA mandate repairs to individual units with no consistency?

I recently received a maintenance order to repair the sidewalk servicing my unit. The corner of one of the slabs was raised about an inch and deemed to be a safety hazard. This was caused by a tree root that was growing beneath the sidewalk and action was taken to kill those roots. I notified the management company that the cause of the problem was taken care of and that I would monitor the sidewalk to ensure the slab would level out as the remaining roots die. However, I received a formal notice that the repair was not completed and I could be subject to fines. At this point I asked the management company, Comanco, what the standards are for all the sidewalks. They replied that all sidewalks must be level. After a quick walk through the development I noticed multiple areas, both common and private, where the sidewalk is not level. No action is in place to fix these areas. So, my question is: Does the HOA have the right to single out my unit for repairs without applying these same standards to the entire development?

I read all about homeowners homeowner association troubles-and i am in the middle of the same troubles myself. What I don't understand is-why don't I see a clamor, a push to have the LAWS changed. Otherwise all the griping and complaining and whining will do no good. As it is, all these corrupt homeowner association boards of directors members know they can't be touched. There is something ludicrous, absurd and disgusting about the fact that even the constitution, the "supreme law of the Land", doesn't apply to this so-called "private governments"! is the United States of America a "nation of laws" or a nation of idiots with idiotic laws?

Process servers employed by Peters & Freedman have jumped walls, trespassed, banged on trash bins, and rang the homeowner's doorbell at 9.00 pm on a Sunday night. A writ filed with the Appellate Court states that they have falsely stated they have served papers on a person when they have left it outside without serving anyone. Peters and Freedman have charged inflated service fees of up to $1,000. claiming they made numerous attempts when they did not. Has anyone else had similar experiences with these lawyers? The process servers have also opened up and left papers inside the U. S. Postal mailbox of the homeowner.
