How Do I Get The Developer To Perform Maintenance On Our Condo Complex?

The common areas foilage is dying. the onsite waste treatment plant is not being maintained, the stench of sewage fills the air.

Here's the situation.

We live in a condo complex in Kona, Hawaii. Owners and renters reside in the units. We own and have lived here since August 2007.

The first developer went bankrupt and has since been purchased by a private developer. Building has stopped due to lack of money/economy, and less than half the units have been sold.


We pay about $260.00 a month in maintenance fees. Yet month by month less gets done.

The common areas foilage is dying due to lack of watering. The onsite waste treatment plant is not being maintained and the stench of sewage fills the air.

After numerous calls to the developer's "Contact" person, and to the management company nothing gets done. The developers says they can't afford a board or a property manager.

Does anyone know what we can do now? We as well as other owners are at our wits end!!!

We've heard stories of lawsuits and the odds against winning in them. Fees being tacked on as assessments...

If anyone has any ideas please let me know.
