How Do I Get The Developer To Perform Maintenance On Our Condo Complex?

The common areas foilage is dying. the onsite waste treatment plant is not being maintained, the stench of sewage fills the air.

2. There are lots of things you can be doing.  
  You alone, have paid over $6000 in dues to these peeple.

Depending on the size of your community, that's a pretty good chunk of change. I would say, find out the number of homes in your community, multiply that by the monthly dues, and multiply that by 12 to see what they bring in over a 1 year period. Use that as a base figure.

Then get an estimate (hopefully you have a friend) on one item, like say the landscaping, or the sewage problem. Then go to them with these figures and ask for invoices as to where they have been spending your hard earned dues. This is just a start. There are lots of things you can be doing. But I would start there.

1. Creative self-reliance between neighbors may be your best bet -- as well as your only practical resource.  
  I live in a planned unit neighborhood with similar issues. I suspect there will be stories nationwide soon. If a developer cannot sell new homes, where is the money for maintenance to come from? The developer only has two choices: go bankrupt or spend himself broke.

If you have health and safety issues, like sewage, you may be able to report it to county officials and they might enforce something.

Beyond that, when it comes to cosmetics like landscape, you owners may have to accept that you are on your own, then see what you can do to pitch in and help, just do it yourselves, or even start your own separate fund for hiring it done (since the developer could go bankrupt). See if there is a lawyer in your community.

It amazes me how many people seem to think that developers have bottomless pockets. I am not a developer, but I am a businss person and I know that business owners can't print money. In today's environment, it doesnt matter what you were told or sold when you purchased if there is no new money coming in. Creative self-reliance between neighbors may be your best bet -- as well as your only practical resource.
