With the growth of new concepts of land use and community development, a new level of government, homeowners associations, have been interjected into our legal system.
Seemingly innocuous CC&R's intended to both guide the development and maintain standards, primarily architectural, in new communities, have, as a result of a perplexing combination of individual homeowner pettiness and lust for power and social engineering by courts, created a fertile field ready for the cultivation of legal fees by those inclined to stir the imbroglio, and more sadly brought anger and often despair to those who anticipated easy enjoyment of their hard earned and usually not inexpensive homes.

My condo - my first home which I poured my heart and soul into, was illegally foreclosed on by the Condo Home Owners Association for unpaid fines which to this day I have no clue what the fines were for.
I was never notified, warned, nothing! It was not uncommon for a new rule to be passed by the President who literally took complete control of the HOA, occasionally I would receive notice of the new rule (generally something quite ridiculous) and many times the new rules would solely apply to a single person/owner.

AB 512 restores important homeowner rights

AB 512 is an important step in repairing the problems created by the deeply flawed Davis Stirling Act. (Gray Davis chose the leading lobbyist of the homeowner association industry, Katherine Rosenberry, to write this landmark legislation. It was analogous to choosing the tobacco industry to write legislation regulating tobacco.)
The central provision of AB 512 is to give some measure of power to homeowners when they feel that their board of directors have made rules that are unwise, onerous, capricious, or downright against common sense. 5% of the homeowners can call a special meeting and then overturn the board's decision by majority vote.

Which California recall candidate will help you protect your home and preserve your equity?
Will it be "The Terminator"?
Let's ask Arnold if he has the muscle and guts to help protect the American dream of home ownership.
HOW? By repealing and making illegal what has been referred to as "foreclosure by neighbor" provisions written into Gray Davis' Davis-Stirling Common Interest Development Act and/or homeowner association covenants, conditions and restrictions (CCR's).
The Davis-Stirling CID Act is also known as the Davis-Stealing Act. It is the reason many HOA housing consumers have voted to recall Gray (skies) Davis. These same homeowners want to elect a candidate who will denounce the HOA legalized housing scams and help to return the American dream of home ownership back to its rightful owner - the homeowner.

On September 10, 2003, Florida Speaker of the House Johnny Byrd (R) Byrd Representative Julio Robaina, (R-South Miami) as chairman of the Select Committee on Condominium Association Governance.
"Thousands of Floridians all across this state live in condominiums," said Representative Robaina. "This Select Committee will work diligently to analyze how current laws affect condominium governance and condominium residents."
The Select Committee on Condominium Association Governance will take public testimony and review current laws regulating the governance of condominium associations to identify any improvements in those laws that might be recommended. The Select Committee will issue a report prior to the beginning of next session outlining any recommendations for legislation consistent with the committee's conclusions.
In a statement to AHRC, Florida House Representative Robaina's office reported there has been many complaints by homeowners on the lack of financial disclosures on maintenence dues and special accessments, fraud and other wrong doing by association boards. The Committee will begin the first of it's Town Hall Meetings on September 23, 24, 25, 2003 in Miami, Florida.

Government need to look into foreclosures under the Davis-Stirling Act.
Yes, flying a flag is important, but Gov. Gray Davis and other government officials need to be looking to change the "foreclosure without due process of the courts" which he put into the law through the Davis-Stirling Act. Davis signed this bill, which allows homes in homeowner associations to be taken away from them and then sold for as little as $1,000.

Governmental refusal to warn home buyers of all the consequences of purchasing an HOA home represents a public policy of deception
Homebuyers are not being informed about: 1. the loss of homestead exemption 2. the lack of government intervention and enforcement when HOA boards violate state laws 3. the lack of a separation of powers and checks and balances that permit autocratic government to flourish 4. the lack of an independent election commission to validate elections 5. there are no standard documents approved or required by the state 6. the HOA attorney will not come to his aid in a dispute regarding board violations of state law of its governing documents -- he must use his own money. 7. he has surrendered many of his property rights to a communal decision process that can obligate him to additional financial burdens without his approval. 8. the CC&Rs are a legal binding contract that can and often does result in financial consequences in the event of nonpayment of assessments or unsubstantiated fines.
