17. Lawyers preying on HOA homeowners

Throughout our nation, these days, there are shyster lawyers preying on HOA homeowners. The sole reason for doing that appears to be money, and the power that money brings.

One of the worst in that regard, many if not most HOA homeowners believe, is a nationwide organization of lawyers-lobbyists named the Community Associations Institute aka the "CAI". Their lawyers-lobbyists appear to be extremely well-connected, politically, in every state in the U.S.

And that appears to be answer to your question. That is, they are not "disbarred" because they are protected by their cohorts, much like used to happen years ago with the "families" which were collectively called the "Mafia". And their "family circle" is known as the "HOA Industry" which can, and often does, include some or many state legislators, members of their state's Bar (lawyers), developers, builders, real estate agents and their agencies, homeowners associations' boards of directors (and their "family" cabal), and "vendors" (those who sell services and products to HOAs).

So, check David Peters out verrrry carefully before you say or do ANYTHING in your HOA, just as you would anyone else that you might hire to do work for you personally.

You, and others in your HOA, are paying for his legal services (if he is your HOA attorney). You all have an obligation -- personally and collectively -- as HOA members to be certain you have the best (competent, honest person with integrity) you all can afford as your HOA's attorney.

Make sure David Peters is that person before you say or do anything, as a homeowner, in your HOA.

After years of observing what these kinds of people do to innocent homeowners, and experiencing their corrupt and devious practices firsthand, we beleaguered homeowners no longer wonder. 13. Mr. Peters stated at a subsequent meeting of homeowners that he could file and not tell or receive approval from owners.  
  The firm of Peters and Freedman filed a deconstruction lawsuit for our Association, against builder and sub-contractors, but failed to notify the owners of the lawsuit as required by law. Then in the original pleading to the court, the firm (Peters and Freedman) represented to the court that they had provided notification the owners. Mr. Peters stated at a subsequent meeting of homeowners that he could file and not tell or receive approval from owners. Mr. Peters said, "all he needed was permission from the HOA board".

After the case was filed, the firm (Peters and Freedman) tore through the homeowners units looking for anything to justify their lawsuit. All the property owners thought that the lawsuit was going to cover any damages to their interiors of their unitst. Peters and Freedman never told the owners that the lawsuit only covered the exterior of the buildings.

Question: why did P& F approve tearing up unit after unit, instilling the impression that the homeowners were going to get something from the lawsuit? I believe that by using this tactic none of the owners would complain!

My deceased husband, who had previously worked for the CIA for 16 years and knew something about collusion, told me that the builder had offered to settle with the HOA board for $500,000.00, but Peters told the board he could get them millions.

Our Association got just a little over $300,000.00 from the settlement, and more hate and discontent between owners and the HOA board.

11. Foreclosure victim's son claims: "My father lost his home when this David Peters filed a quit claim deed against his property."  
  My father is listed in one of your articles titled Investigation on Homeowner Association Foreclosure Filings.

My father lost his home when this David Peters filed a quit claim deed against his property. My father had no knowledge that the property could have a quict claim deed filed on his home by the HOA. If he had known I would have purchased his property.

Please let me know the status of the case Carlos Sosa vs xxxx as I would like to see both Carlos Sosa and David Peters go to prison for as long as possible for violating My fathers rights under the Constitution of the United States in reference to the right of his property.

8. GET BACKGROUND CHECKS on all parties involved in the HOA corporation  
  Let this be a warning to homebuyers considering a purchase into a homeowner association.

GET BACKGROUND CHECKS on all parties involved in the HOA corporation from the property managers, individual boards of directors, maintenance vendors, the lawyers, the insurance broker/agent, etc. Leave out no one.

Find out who controls the HOA and how many lawsuits the HOA has been involved in as well as how many foreclosure actions the HOA lawyers have been involved in.

Be educated. Know every damn law there is to know related to HOA housing.

Don't forget, the laws can change even before you have a chance to move in!!
