RESERVE FUNDS SHOULDN'T BE USED FOR ROUTINE MAINTENANCE [An Article]

QUESTION: I live in a California common-interest development of fewer than 50 condominiums. Our treasurer insists that money from the reserve fund that is used for replacing the decorative part of the roof, repairing the hot water system, etc., be replaced immediately after the funds are withdrawn. He says that unless the projects are funded by imposing more assessments or borrowing until the reserve is equal to the recommendation of the reserve study, he will personally be subject to civil and possibly criminal penalties. We go from one never-ending assessment to another while the reserve account deposits grow and grow to now several hundred thousand dollars. How do we owners stop this madness? ANSWER: Stockpiling money in a reserve account is not necessarily smart or even the correct thing to do under the Davis-Stirling Act. Reserve accounts are not required by law, and the most popular reason to have one is to ensure that enough money is on hand to repair or replace major common-area components when needed. .....

As the economic recession continues on and on, and as tens of millions around the world die because of it, we need to ask some fundamental questions about what an economy is, what is an economy for, how do we organize a truly humane economy? The U.S. has had 32 recessions since 1854. Since 1913, the average length has been 13 months. Our current recession is now in its 20th. month. The White House projected that with the Economic Stimulus Package, unemployment would not hit 9% until mid-2010. We are already at 9.5%. Housing prices continue to fall, and look destined to fall even further as more and more people become unemployed and are unable to pay their mortgage. The resulting foreclosures trigger further declines in housing prices. At least 20% of all American homeowners are underwater - they owe more on their homes than their homes are worth.

Peters & Freedman lawyers have been advising foreclosure lobbyists and lawyers in government (e.g. Community Associations Institute, California Department of Real Estate lawyer ..., real estate commissioner, Clark Wallace). They use their connections to help pass laws to farm for, and then sue homeowners, and then take their homes and life savings, and trap and strip them of their basic human rights in homeowner associations. The San Diego District Attorney, the State Attorney General and other government representatives have conveniently ignored the foreclosure fraud committed by foreclosure lawyers. Gretchen Spencer was the assistant to foreclosure lawyer Michael G. Kim (partner of Peters & Freedman) in June of 2005. She handled the paperwork for these lawyers and interfaced with messengers etc. while ignoring the reports of fraud and abuse. Instead, she assisted with the abusive lawsuits and fraudulent foreclosures by Peters & Freedman lawyers.

Homeowner Elaine J. Campbell , (a retiree working as an editor an book reviewer) has published the following complaints about her Tierra del Sol HOA
• JoAnne White - independent bookkeeper. $80. per month Husband James White is sometimes a board member and does plumbing work for the HOA ($1,694. in 1966)
• Ms Cummins
• Teresa Ann Clayton - 2008 President - unqualified
• HOA has 5 board members instead of 3 that HOA docs stipulate
• Elections: Homeowners are not given any information on qualifications of board members
• HOA meetings - groceries purchased with homeowner maintenance dues
• Pool use problems: "Management reserves right to deny use of pool to anyone anytime"
Homeowners working form home without business licenses - bookkeeping,
• ruling Marsicola family - usually one or two on the board - owns many homes , complaints on non-payment of dues. Gina Koch , a Maarsicola, was president. Maintenance dues used to give donation to charity when matriarch of Marsicola, a non-resident died.

Calpers to sue credit agencies over ratings [An Article]

Credit rating agencies are back in the spotlight, facing a lawsuit from the largest pension fund in the US over what it says are "wildly inaccurate" ratings and heightened scrutiny from regulators. The California Public Employees' Retirement System (Calpers) is suing the three leading credit rating agencies over potential losses of more than $1bn related to structured investments that were rated AAA but contained risky mortgage debt.

Report urges UK banking transparency [An Article]

Banks must brace themselves for a rash of board-level bureaucracy, if the proposals of the Walker Review on financial sector corporate governance, published on Thursday, are accepted. Sir David Walker, the former chairman of Morgan Stanley International, and author of the report, said financial groups should set up board risk committees, separate from audit committees, to ensure executives are not allowed to run amok.

Hundreds of City high-flyers could have their remuneration details published - but opposition MPs are critical

Plans to reveal the pay and bonuses of City high flyers in a new voluntary code came under attack from opposition MPs, who said the guidelines would be ignored unless they were enshrined in regulation and policed by the main financial watchdog. A government-backed review recommended that some of the best-paid bank staff, who are currently shielded from scrutiny, should be included in annual reports as part of a wide range of measures designed to discourage risky behaviour...The review by former investment bank boss Sir David Walker argued that exposing pay structures for highly paid staff in the City and putting an end to short-term bonuses would help prevent a repeat of the financial crisis. Bonuses would be delayed for between three and five years and put under scrutiny by a beefed-up remuneration committee. Non-executive directors of finance companies would be required to spend more time assessing deals put forward by executive directors, Walker said.

JPMorgan quarterly profits jump 36% [An Article]

JPMorgan reported record revenues in the second quarter on Thursday as soaring investment banking fees drove profits in spite of swelling loan losses. The US bank's earnings beat analysts' most bullish expectations, jumping 36 per cent and producing net income of $2.7bn, or 28 cents a share, compared with $2bn, or 53 cents, in the same quarter the prior year.

Israel warships move within cruise-missile range of Iran [An Article]

Tel Aviv takes a step closer to war with Tehran as two Israeli warships sail through the Suez Canal within cruise-missile range of Iran. Earlier this week, two Israel Navy gunboats, the Hanit and the Eliat, passed through the Suez Canal and across the Red Sea. In a Thursday interview with the Times, a senior Israeli defense official said the move should be seen as serious preparations for a long-expected attack on Iranian nuclear sites....Tel Aviv, the alleged possessor of the sole nuclear arsenal in the Middle East, accuses Iran of secretly enriching weapons-grade uranium to attack Israel. Iran says it has no such intentions and has asserted that its uranium enrichment is a peaceful drive to produce electricity.

In Afghanistan, US bombings kill civilians [An Article]

US war planes have killed and injured dozens of civilians in southern Afghanistan in attempted bombings of suspected Taliban militant hideouts. The latest incident happened overnight in southern Kandahar province. Residents in Shah Wali Kot said up to six people were killed and 16 wounded in the air attack in the district. Another two people were reportedly killed and four others were wounded in neighboring Miawand district when US helicopters fired missiles in the region. This is not the first violent US attack on civilians in Afghanistan. More than 140 Afghan civilians were killed in a series of US airstrikes in the western Farah province in early May. Additionally, some 1,000 civilians have lost their lives in the past five months during clashes between US-led troops and insurgents affiliated with the Taliban. US bombing campaigns have drawn sharp criticism from Afghans and the government of President Hamid Karzai.
